1. Service Description

NakedPnL operates a public registry of verified investment performance. The registry ranks institutional funds and verified private investors by returns sourced from SEC filings and direct brokerage integration. NakedPnL is not an investment advisor, broker-dealer, or financial institution. The registry is an informational service only.

2. User Accounts and Submissions

To submit performance data for verification, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials. All performance data submitted to NakedPnL must be accurate and supported by verifiable documentation. Submitting falsified, misleading, or fabricated performance data is strictly prohibited and may result in permanent removal from the registry.

3. Verification Process

“Verified” on NakedPnL means that submitted performance data has been reviewed and approved by the NakedPnL team. Verification is based on documentation provided by the submitter, including SEC filings, brokerage statements, or administrator attestations. Verification does not constitute a third-party audit, financial guarantee, or endorsement of any investment strategy. Past performance, even when verified, is not indicative of future results.

4. Data Integrity

All records on the NakedPnL registry are maintained in an append-only system. Corrections to previously submitted data are appended as new entries rather than overwriting existing records. This approach ensures a complete and transparent history of all submissions and modifications. NakedPnL reserves the right to annotate, flag, or remove entries that are found to be inaccurate or in violation of these terms.

5. Intellectual Property

The NakedPnL name, logo, registry design, verification methodology, and all associated content are the property of NakedPnL. You retain ownership of the performance data you submit, but grant NakedPnL a non-exclusive, worldwide license to display, rank, and distribute that data as part of the public registry. You may not scrape, reproduce, or redistribute registry data without prior written consent.

6. API Credentials and Exchange Connections

When you connect an exchange account (e.g., Binance, Kalshi) to NakedPnL, you submit API credentials that are encrypted at rest using AES-256-GCM. NakedPnL only requests and uses read-only access to your account data. We never execute trades, place orders, or initiate withdrawals on your behalf. You are solely responsible for ensuring that any API keys you provide have only read-only permissions enabled. NakedPnL rejects API keys with trading or withdrawal permissions but cannot guarantee detection of all permission configurations across all exchanges. You agree to fully indemnify NakedPnL from any unauthorized account activity resulting from improperly scoped API keys. You may revoke your credentials at any time from your exchange account settings.

7. Limitation of Liability

NakedPnL provides the registry on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of registry data. NakedPnL shall not be liable for any investment decisions made based on information displayed on the registry. In no event shall NakedPnL be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

7. Modifications to Terms

NakedPnL reserves the right to modify these terms at any time. Material changes will be communicated via the email address associated with your account. Continued use of the service after changes take effect constitutes acceptance of the revised terms.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in New York County, New York.
